An action was commenced by three plaintiffs as beneficiaries under a will claiming damages and other relief for alleged breaches of trust. After the action had proceeded for some time one of the plaintiffs alleged that she had given no authority to the solicitor to institute such an action, and refused to take any steps to further the proceedings or to join in any application. The other co-plaintiffs were not able to proceed in the action in consequence of the position thus taken up by the third plaintiff, and they applied by summons for an order striking out the name of such plaintiff as a plaintiff and joining her as a defendant.
