The plaintiff employed his broker to sell certain shares. The defendants, who were also brokers, acting for an undisclosed principal, bought these shares on the Melbourne Stock Exchange by a verbal contract in accordance with the usage and rules of the Exchange. After the sale the plaintiff paid certain calls due on the shares, and brought an action against the defendants to recover the amount so paid.
