One P. had carried on business in London, Melbourne, and elsewhere as a bookseller. On 19th July 1894 he was adjudicated bankrupt in England, but no insolvency or bankruptcy proceedings were taken against him elsewhere. Plaintiff, a bank domiciled in Victoria, from time to time advanced money to P. to enable him to carry on his business in Victoria and to import goods. To secure these advances the plaintiff received from P. the bills of lading of consignments of books, the bills of lading being indorsed absolutely to it. These
