The defendant was prosecuted for selling liquor without a license, but no evidence was given for the prosecution that the locality of the alleged offence was within the jurisdiction of the adjudicating court. After the case for the prosecution was closed, a witness for the prosecution gave evidence that he had heard that the locality was such as to bring it within the jurisdiction, and the Court convicted the defendant.
