The defendant was charged, under sec. 178 of the Licensing Act 1928, that on a Sunday a traffic in liquor unlawfully took place on his licensed premises. The evidence was that on a Sunday morning a man standing in the street spoke to a woman who was standing in the doorway of the hotel, and that shortly afterwards a window of the hotel was opened from within and a woman handed out through the window a bottle of beer to the man, who was then standing in the street near the window.
