McPHERSON v. GOLDSTONE Supreme Court of Victoria CUSSEN, J. August 5, 09 August 1920 Police offences — Person accused of having in his actual possession personal property suspected of being stolen — Property parted with by prisoner before suspicion attaches — "Suspected goods" — Costs of Special Case — Police Offences Act 1915 (No. 2708), s. 40 (3) — Justices Act 1915 (No. 2675), s. 147 (as amended by Act No. 2875) .

To justify a conviction, under sec. 40 of the Police Offences Act 1915, of a person charged with having in his actual possession property suspected of being stolen, it must be established that the suspicion of the property being stolen existed while the accused was in possession of such property.
