The defendant gave a promissory note for 100l. to one R. upon the condition that R. was not to present the note for payment until defendant had received the proceeds arising from a sale of certain property. It was proved that defendant never received any proceeds of the sale of her property. R., in contravention and fraud of this condition, indorsed the note to the plaintiffs in payment of a debt for 14l. The plaintiffs sued defendant on the note for the full amount of the same.
