By the terms or an agreement between lessor and lessee, the lessee was allowed to enter upon the land demised, and to "quarry by blasting or otherwise," and "to win, work, and carry away the stone" from the ground. The agreement as to the payment of rent was, that the lessee should pay a sum of money in respect of all men "engaged in quarrying on the said land, but not for men employed only as carters or in making or repairing the roads."
